I. General Terms and Conditions
The cruise itself and any associated services –
in particular meal service and entertainment events
– are subject to the provisions of the present
Terms and Conditions of Sale, which take precedence
over all terms and conditions of purchase, to which
latter Les Bateaux Parisiens shall not be bound. Any
reservation or purchase of a service implies full
compliance with the present Terms and Conditions of
Sale, without further notification or formality.
II. Conditions of Reservation
and Payment
Reservations are compulsory for cruises –
meals and can be made by mail, e-mail, fax, telephone,
or on the premises.
The exact number of passengers must be confirmed
no later than two working days before the date of
the cruise. For a group of more than 14 persons
the choice of a single menu from the à la
carte menu for all passengers in the group shall
be requested no later than 12 days before the date
of the cruise. In the absence of expression of such
choice, the single menu shall be chosen by the chef.
For cruises open to the
Public :
Unless there is express agreement to the contrary,
reservations are not final until sending of written
confirmation and a pre-payment of 100% of the amount
of the services ordered. Additional passengers shall
be admitted as places are available.
Vouchers (or exchange coupons) shall be accepted
only when issued by an intermediary approved by
Les Bateaux Parisiens.
For private cruises :
Reservations do not become final until reception
by Les Bateaux Parisiens of the signed price quotation
accompanied by payment of a first installment of
50% of the total amount, including taxes, of the
quotation. A second payment of 40% of the total
amount of the quotation must be made 10 days before
the date of the cruise, without formality on the
part of Les Bateaux Parisiens, the balance to be
paid no later than the time of embarkation. Failing
such payments, the reservation shall become null
and void without further formality and the provisions
of Article III of the present Terms and Conditions
shall be applicable.
Cancellation by the client
:
Cancellation more than 30 days before the planned
date: an indemnity corresponding to the costs incurred
by Les Bateaux Parisiens shall be remitted by the
client.
Cancellation less than 30 days before the planned
date: a penalty representing 50% of the total price
including tax of the cruise is due.
Cancellation less than 10 working days before the
cruise or failure of the client to appear at time
of embarkation: a penalty representing 100% of the
total price including tax of the cruise shall be
due.
Les Bateaux Parisiens nevertheless reserves the
right to place the unused cruise places on sale.
The aforementioned penalties shall nonetheless remain
due the company.
III. Cruise Regulations
1) Les Bateaux Parisiens shall do all in its power
to ensure the satisfactory progress of the cruise
under the Terms and Conditions governing the reservation.
In no case shall Les Bateaux Parisiens be held responsible
nor required to pay any indemnity or reimbursement
in case of modification of the itinerary, the schedule,
or the duration of a cruise resulting from an act
of God or force majeure or instructions given by
the navigational authorities.
2) Adherence to schedule:
The passenger, or the entire group, must be present
at the point of embarkation no later than 15 minutes
before the planned departure time.
Should the passenger arrive after the departure
of the boat, he or she shall be entitled to no reimbursement.
For private cruises: Les Bateaux Parisiens reserves
the right to reduce the length of the cruise by
a period of time equivalent to the client’s
delay in arrival at the point of embarkation.
3) Obligation of passengers:
• From the moment when he or she is invited
to embark, each passenger must comply immediately
and strictly with the instructions given by the
personnel of the vessel in the interest of navigational
safety and of good order on board.
• No animals and no substance or device which
could prove dangerous for the passengers or the
personnel shall be allowed on board.
• Les Bateaux Parisiens shall not be held
responsible in case of theft or damage to clothing,
hand baggage, or equipment belonging to clients.
• Les Bateaux Parisiens reserves the right
to bill clients for any and all damage to equipment
on board caused by the client or a member of his
or her group.
• Proper attire shall be required (no jeans
or sport shoes) for meal cruises. Les Bateaux Parisiens
reserves the right to refuse access to the vessel.
• Without special permission, unauthorized
persons are not allowed in the engine area, pilot
station, or kitchen.
External artistic events:
Events are organized by Les Bateaux Parisiens. If
the client, with permission, wishes to organize
this part of the service himself, he or she hereby
agrees to supply the following to the Company: quotation
or invoice from the service provider or prior declaration
of engagement of the artists, proof of valid civil
liability insurance (or service provider’s
insurance). If these documents have not been supplied
two working days before the performance, the service
provider or the artists shall be refused access
to our boat.
IV. Insurance-Liability
Since cruises are subject to the rules governing
navigation of inland waterways, Les Bateaux Parisiens
reserves the right to judge the state of navigability
of the river. Cruises may be cancelled or changed
at all times from the time of reservation, including
the planned date of departure, in application of
the aforementioned rules, or in case of inclement
weather such as might endanger the safety of the
persons aboard.
Les Bateaux Parisiens shall not be held responsible
for the consequences of passengers’ failure
to observe the present Terms and Conditions of Sale
and specific and general police regulations, without
prejudice to any damages and interest it may claim
due to losses it has suffered as a result of such
failure.
Les Bateaux Parisiens shall not be held responsible
for damages or losses undergone by passengers during
the cruise when such damages or losses are the result
of one of the following causes: sudden flooding,
storm, collision with another vessel responsible,
even partially, for the accident, and any other
unpredictable event.
V. Rates, Billing & Payment
The applicable rates are those corresponding to
the effective date of the cruise. The rates for
services are revised on April 1 and November 1 of
each year. Delayed billing is subject to prior approval
of Les Bateaux Parisiens. Should it be approved,
each invoice must be paid by check or bank transfer
on reception or no later than 15 working days after
the date of billing. Any delay in payment shall
result, without further formality, in the billing
of delinquency interest calculated on the amount
due before taxes as principal, at a rate of one-and-a-half
times the legal rate of interest as per the provisions
of Law 92-1442. This delinquency interest shall
be applied from the day after the due date for the
principal through the date of full and total payment.
No discount shall be granted for cash payment.
Applicable legislation:
In case of dispute or claim, the French jurisdictions
shall be the only competent ones and French law
the only applicable law.
Disputes with clients registered with the Commercial
Register and corporations shall be referred to the
Paris Tribunal de Commerce.
